What is penalty abatement?
Penalty abatement is the removal or reduction of IRS penalties. The IRS may abate penalties when taxpayers demonstrate reasonable cause for the failure or qualify for first-time penalty abatement. Common penalties eligible for abatement include failure to file, failure to pay, and failure to deposit. Abatement removes the penalty itself but generally does not eliminate the underlying tax or interest.
First-time penalty abatement
The IRS offers administrative relief for taxpayers with a clean compliance history. To qualify, you must have filed all required returns, have no penalties in the prior three years, and have paid or arranged to pay any tax due. First-time abatement is granted relatively easily when criteria are met. It applies to one penalty per tax type, so use it strategically on the largest penalty.
Reasonable cause abatement
Beyond first-time relief, penalties may be abated for reasonable cause. This requires demonstrating circumstances beyond your control prevented compliance. Death, serious illness, fire, natural disaster, or reliance on professional advice may qualify. The IRS examines whether you exercised ordinary business care and prudence. Document the cause, the timeline, and steps taken to comply as soon as possible.
